1. Definitions

• slimzaak: slimzaak, a trade name of For Kıvanç Bilişim Ev Dekorasyon Dış Ticaret San. ve Tic. Ltd. Şti., based at Pınar Mah. 74229 Sok. Safir Life Sit. A Blok No:16 İç Kapı No:6, Seyhan / Adana / Turkey.
• the Service: the online platform for accounting, invoicing and administration automation, available at https://slimzaak.nl and https://app.slimzaak.nl.
• User / you: the natural or legal person acting in the course of a profession or business who enters into an agreement with slimzaak.
• Subscription: the agreement for the use of the Service under the selected plan and rate.

2. Applicability

These terms apply to every use of the Service and to all agreements between slimzaak and the User. Deviations apply only if agreed in writing. The Service is intended for business use; by creating an account you declare that you are acting in the course of a profession or business.

3. Account and use

An account is required to use the Service. You are responsible for providing accurate and up-to-date information when registering, for keeping your login credentials confidential, and for all use that takes place through your account. You may not use the Service in violation of laws and regulations, for sending misleading invoices, or in a manner that harms the operation of the Service or the interests of other users. slimzaak may suspend or terminate an account in the event of misuse or violation of these terms.

4. Subscriptions and payment

The current plans and prices are listed at https://slimzaak.nl. All prices are in euros and exclude VAT. Monthly subscriptions can be cancelled on a monthly basis and run until the end of the current billing period. Annual billing carries a discount of 2 months: you pay 10 times the monthly price for 12 months of use. Payment is made in advance for the selected billing period. In the event of late payment, slimzaak may suspend access to the Service after you have been given the opportunity to pay. All payments are processed by Paddle.com, which acts as our Merchant of Record. By making a purchase, you agree to Paddle's Buyer Terms. Paddle handles payment processing, sales tax/VAT collection, and refund requests.

5. Refunds and cancellation

In line with Paddle's Buyer Terms, you can request a full refund within 14 days of your purchase or renewal. Refund requests can be submitted via Paddle or by emailing [email protected].

Our cancellation policy for subscriptions is simple: you can always start for free to try slimzaak without obligation, and every paid subscription can be cancelled monthly, effective at the end of the current billing period. After cancellation you pay nothing for the next period.

6. Free plan and trial periods

slimzaak offers a free entry-level plan and, for certain plans, a trial period. Usage limits may apply to the free plan, such as a maximum number of invoices per month. slimzaak may change the contents of the free plan or discontinue it, in which case you will be informed in good time.

7. Fair use

Use of the Service is subject to a fair use policy. Unlimited features are intended for normal business use appropriate to the selected plan. In the event of use that structurally and significantly exceeds normal use, or that endangers the stability of the platform, slimzaak may contact you to agree on a more suitable plan or reasonably restrict the use.

8. Availability and maintenance

slimzaak will make every effort to keep the Service available as reliably and uninterruptedly as possible, but does not guarantee any specific availability percentage. slimzaak may carry out maintenance and temporarily take the Service out of operation; scheduled maintenance is performed outside office hours where possible and announced in advance. The Service depends on integrations with external platforms; slimzaak is not responsible for the availability of, or changes to, those external services.

9. Liability

slimzaak's total liability, on whatever legal basis, is limited to the amount you paid for the Service in the 12 months preceding the event causing the damage. slimzaak is not liable for indirect damage, including lost profit, missed savings or loss of data, unless there is intent or deliberate recklessness. You remain responsible for the accuracy and completeness of your administration and for filing tax returns correctly and on time; the Service is a tool and does not replace an accountant or tax adviser.

10. Intellectual property

All intellectual property rights to the Service, the software, the design and the documentation are vested in slimzaak or its licensors. You are granted a non-exclusive, non-transferable right of use for the duration of the Subscription. The data you enter into the Service or retrieve through integrations remains yours.

11. Privacy and data processing

Our privacy policy, available at https://slimzaak.nl, applies to the processing of personal data. Where slimzaak processes personal data on your behalf, the data processing arrangements agreed for that purpose additionally apply.

12. Changes

slimzaak may amend these terms and the Service. Material changes will be announced in advance via the website or by email. If you do not accept a change, you may cancel the Subscription with effect from the date on which the change takes effect.

13. Applicable law and disputes

These terms and all agreements with slimzaak are governed by Dutch law. Disputes will be submitted exclusively to the competent court of the District Court of Rotterdam, unless mandatory law provides otherwise.
